When a seller does not need a register: the marketplace agency scheme

When a seller does need an online cash register

The obligation to apply a cash register switches on as soon as the buyer's money reaches you directly, bypassing the marketplace. Under 54-FZ, organizations and sole proprietors must apply a register for settlements — cash and cashless, including card payments and invoices paid by individuals. Typical seller scenarios:

  1. Your own online store with payment processing (acquiring, SBP, payment links) — a register is required; the receipt is generated at the moment of payment, including night-time online payments (cloud registers exist for this).
  2. A retail point or showroom — a classic register at the point of settlement.
  3. Delivery by your own courier with payment on receipt — the receipt is issued at the moment of settlement (a mobile register with the courier) or a remote register in cases the law allows.
  4. Taking payment directly from a buyer in chat, by card number, "by arrangement" — that is also a settlement: a register is required, and transfers "to a personal card" additionally create tax risks.

Does a self-employed seller need a register?

No — neither for marketplaces nor for direct sales. Payers of the professional income tax (NPD) are exempt from cash registers; the buyer's receipt is generated in the "Moy Nalog" app (a rule of 54-FZ and the self-employment law 422-FZ). Remember the regime's own limits: NPD is only for goods of your own production and income up to 2.4M RUB per year; resale and labeled goods are prohibited on NPD.
